Threshold For Employees Exempt

There were a few significant changes in Wyoming, reflecting the current economic status while ensuring fair compensation for workers. On April 23, 2024, the Department of Labor (DOL) announced an update to the Fair Labor Standards Act (FLSA).  

According FLSA,   

  • Exempt employees are those who are exempt from overtime regulations, paid a salary, and perform administrative, professional, executive, computer, or outside sales work.   
  • Non-exempt employees are those paid hourly, perform more manual or technical duties, and are entitled to overtime pay for any hours worked beyond 40 in a work week.    

Starting July 1, 2024, the minimum annual salary to qualify for these exemptions will rise from $35,568 to $43,888, translating to $844 per week. 

The threshold will increase to $58,656 per year or $1,128 per week effective January 1, 2025. For Highly Compensated Employees (HCE), the annual salary threshold will jump from $107,432 to $132,964 on July 1, 2024, and then to $151,164 on January 1, 2025. 

Historical Data of Wyoming Minimum Wages 

Wyoming’s state minimum wage remained at $1.60 for 13 years before being raised to $5.15 in 2002, aligning it with the federal minimum wage.  

Thus, under Title 27 of the Wyoming Statutes, the Legislature established laws which was revised in April 2001. 

So, the basic minimum rate (per hour) is $5.15.  However, employers subject to the Fair Labor Standards Act must pay the current Federal minimum wage of $7.25 per hour.

Exemptions in Minimum Wages of Wyoming 

The Wyoming state minimum wage law exempts; 

  • Individuals working in agriculture. 
  • Individuals in domestic service. 
  • Individuals in bona fide executive, administrative, or professional roles. 
  • Individuals employed by the U.S. government, the state, or its political subdivisions. 
  • Individuals involved in educational, charitable, religious, or nonprofit organizations where there is no actual employer/employee relationship, or the work is voluntary. 
  • Employees under 20 years old can be paid $4.25 per hour for their first 90 days of work; after that, they must earn a minimum wage of $5.15 per hour. 
  • Outside salespeople who earn commission only on their sales. 
  • Individuals who drive an ambulance or other vehicles occasionally are on call as needed.
