Threshold For Employees Exempt

On April 23, 2024, the Department of Labor announced a significant change to the Fair Labor Standards Act (FLSA) regarding the minimum salary threshold for overtime pay. This change may affect certain employees currently classified as exempt.  

According FLSA,   

  • Exempt employees are those who are exempt from overtime regulations, paid a salary, and perform administrative, professional, executive, computer, or outside sales work.   
  • Non-exempt employees are those paid hourly, perform more manual or technical duties, and are entitled to overtime pay for any hours worked beyond 40 in a work week.   

The minimum annual salary required for exemption from the FLSA’s minimum wage and overtime provisions is currently $35,568 

This threshold will increase to $43,888 starting on July 1, 2024, and to $58,656 effective January 1, 2025.

Exemptions in Minimum Wages of Mississippi
